These Terms of Service ("Terms") govern your access to and use of The Mortgage Stack, a product operated by Simple Software LLC ("we," "us," or "the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Mortgage Stack helps mortgage professionals build relationships with real estate agents. It compiles information about agents in a market you select, verifies contact information, and sends outreach on your behalf from an email inbox you connect, then surfaces the replies. You direct who is contacted and control the account and inbox used.
You must be at least 18 years old and use the Service for lawful business purposes. You represent that you are a licensed mortgage professional (or are duly authorized to act for one) and that, if you use the Service on behalf of a company, you have authority to bind that company to these Terms.
You are responsible for the accuracy of the information you provide, for maintaining the security of your credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
To send and read messages on your behalf, you connect an email account (for example, Google or Microsoft) through a secure authorization flow. By connecting an account, you authorize us to send messages from it and read replies to your outreach for the purpose of operating the Service. You may disconnect the account at any time, which stops further sending and reading. You represent that you have the right to use any inbox you connect.
You are the sender of every message the Service delivers on your behalf, and you are solely responsible for your outreach and its content. You agree to comply with all applicable laws and rules, including without limitation the CAN-SPAM Act, the Telephone Consumer Protection Act and Do Not Call rules (for any calls or texts), the Real Estate Settlement Procedures Act, the Equal Credit Opportunity Act and Fair Housing Act, and all state licensing and advertising requirements that apply to you. You agree to honor opt-out and unsubscribe requests promptly, to send only truthful, non-deceptive, non-harassing content, and not to use the Service for any unlawful, misleading, or abusive purpose.
Information about agents is compiled from available sources and is provided "as is." We do not guarantee its accuracy, completeness, or currency. You are responsible for using it lawfully. Individuals who wish to be removed from outreach may contact us at support@themortgagestack.com.
Paid plans are billed in advance on a recurring basis. Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing on prospective notice.
We own the Service, including its software, design, and content, excluding your data and the messages you author. You retain ownership of your content and grant us the limited rights needed to operate the Service for you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant any particular email deliverability, response rate, number of relationships, or business result. Nothing in the Service is legal, compliance, tax, or lending advice. You are responsible for your own regulatory compliance.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold harmless Simple Software LLC and its affiliates from any claims, losses, or expenses (including reasonable legal fees) arising out of your outreach, your content, your use of the Service, or your violation of these Terms or of any law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk or legal exposure. On termination, your right to use the Service ends and sending stops.
We may modify the Service or these Terms. If we make material changes to these Terms, we will provide reasonable notice. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. The exclusive venue for disputes is the state or federal courts located in Colorado.
